These Terms of Service ("Terms") govern your use of the BookedRate website at bookedrate.com and any services provided by BookedRate LLC ("BookedRate," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.
BookedRate provides done-for-you sales automation and operations services for HVAC companies, including but not limited to:
Specific services, deliverables, pricing, and timelines for each client engagement are outlined in a separate Service Agreement signed by both parties prior to commencement of work.
Services are provided on a month-to-month basis following a one-time setup fee. Monthly fees are billed in advance. Setup fees are non-refundable as they cover the time and resources required to build and configure your custom automation system.
You may cancel your monthly service at any time with 30 days written notice to hello@bookedrate.com. You will continue to have access to your system through the end of the paid period. After cancellation, you retain ownership of any automations and data in your account.
If you do not see a meaningful difference in your company's lead capture, response time, or booked jobs within the first 30 days of going live, we will refund your setup fee in full upon written request. This guarantee applies to the setup fee only and does not apply to monthly retainer fees already paid.

You are solely responsible for ensuring your use of automated SMS and email communications complies with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. BookedRate will configure systems in accordance with best practices, but compliance responsibility rests with the client.
All automation workflows, templates, and systems built by BookedRate remain the property of the client upon full payment. BookedRate retains the right to use non-identifying methodology and frameworks developed during client engagements for other clients.
BookedRate is not liable for any indirect, incidental, or consequential damages arising from use of our services, including but not limited to lost revenue, lost leads, or failure to achieve specific business outcomes. Our total liability to you shall not exceed the total fees paid in the 30 days preceding the claim.
BookedRate does not guarantee specific results such as a defined number of leads captured, jobs booked, or revenue generated. Results vary based on factors including your company's call volume, service area, market conditions, and team follow-through.
These Terms are governed by the laws of the State of Utah. Any disputes arising from these Terms or our services shall be resolved in the courts of Utah County, Utah.
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
