These Terms of Service ("Terms") govern your use of the BookedRate website at bookedrate.com and any services provided by BookedRate LLC ("BookedRate," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.
BookedRate provides a done-for-you AI Receptionist service for HVAC companies, including but not limited to:
Specific services, deliverables, pricing, and timelines for each client engagement are outlined in a separate Service Agreement signed by both parties prior to commencement of work.
Services are provided on a month-to-month basis at a flat monthly rate. Monthly fees are billed in advance. There is no separate setup fee. Specific pricing for your account is confirmed in your Service Agreement before billing begins.
You may cancel your monthly service at any time with 30 days written notice to hello@bookedrate.com. You will continue to have access to your system through the end of the paid period. After cancellation, you retain ownership of any automations and data in your account.
If you do not see a meaningful difference in your company's lead capture, response time, or booked jobs within the first 30 days of going live, we will refund your first month's fee in full upon written request.

You are solely responsible for ensuring your use of automated SMS and email communications complies with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. BookedRate will configure systems in accordance with best practices, but compliance responsibility rests with the client.
BookedRate LLC operates a text messaging program to communicate with website visitors and clients. Messages sent through this program may include: real-time handoff alerts sent to our HVAC clients' teams, appointment scheduling and confirmations, service updates related to your inquiry, and account-related communications. If you separately opt in to marketing messages, you may also receive promotional offers and marketing communications from us.

All automation workflows, templates, and systems built by BookedRate remain the property of the client upon full payment. BookedRate retains the right to use non-identifying methodology and frameworks developed during client engagements for other clients.
BookedRate is not liable for any indirect, incidental, or consequential damages arising from use of our services, including but not limited to lost revenue, lost leads, or failure to achieve specific business outcomes. Our total liability to you shall not exceed the total fees paid in the 30 days preceding the claim.
BookedRate does not guarantee specific results such as a defined number of leads captured, jobs booked, or revenue generated. Results vary based on factors including your company's call volume, service area, market conditions, and team follow-through.
These Terms are governed by the laws of the State of Utah. Any disputes arising from these Terms or our services shall be resolved in the courts of Utah County, Utah.
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
